CCJ Set Aside vs CCJ Removal: What Is the Difference?
Many people search for how to remove a CCJ, get a CCJ removed, or clear a CCJ from their credit file. However, there are different routes depending on the circumstances. A set aside application and CCJ removal are related, but they are not the same thing.
What Is a CCJ Set Aside?
A CCJ set aside is where the court cancels the judgment and reopens the case. This may happen where the defendant did not receive the claim, the claim was sent to an old address, or there is another valid reason for the court to reconsider the judgment.
If the judgment is set aside, the CCJ may be removed from the Register and from your credit file. However, the underlying claim may still continue.
What Is CCJ Removal?
CCJ removal is a broader term. It usually means removing the judgment from the Register of Judgments and from your credit file.
Removal may happen because the judgment was paid in full within one calendar month, because the judgment was set aside, or because an error has been corrected.
Set Aside vs Cancellation
Cancellation normally relates to payment within one calendar month of the judgment date. A set aside application is different because it asks the court to reopen the case.
This distinction matters because paying a CCJ does not always mean it will be removed. If payment was made after the one-month period, the judgment may usually only be marked as satisfied.
When Might a Set Aside Be Appropriate?
- The claim was sent to an old address.
- You did not receive the claim form.
- You have a genuine defence to the claim.
- There may have been a procedural issue.
- You acted promptly after discovering the judgment.
When Might Cancellation Be Appropriate?
Cancellation may be appropriate where the judgment debt was paid in full within one calendar month of the judgment date.
In that situation, you may need evidence of payment and confirmation from the claimant or their solicitors that the judgment has been paid in full.
What If the CCJ Has Already Been Paid?
If the CCJ has already been paid, the timing of payment is important. Payment within one month may support cancellation. Payment after one month may usually result in the judgment being marked as satisfied instead.
Is Setting Aside a CCJ the Same as Removing It?
Not exactly. Setting aside a CCJ is a legal process. Removal is the outcome many people are trying to achieve. A successful set aside may lead to removal, but it is not the only possible route.
